A mutual consent divorce in Pune is filed before the Family Court at Shivajinagar and proceeds in two motions separated by a statutory cooling-off period of six months, which courts may waive where the separation has been long and the terms are settled. With a waiver the decree commonly follows in three to five months; without one, roughly eight to twelve.
The decree is the easy part. What matters is the consent terms — custody, access, maintenance, the flat, the loan on the flat, who pays what and when. Terms drafted vaguely produce execution proceedings two years later, by which point neither party is willing to be reasonable. 04How long a mutual consent divorce takes
With the cooling-off period waived, a mutual consent divorce in Pune commonly concludes in three to five months from filing. Without a waiver, expect eight to twelve. Waiver is not automatic — courts look at the length of separation, whether the terms are genuinely settled, and whether reconciliation is realistically possible. 05Common mistakes in mutual divorce
- Vague settlement terms“The husband will pay a reasonable amount towards the child's education” is not enforceable. Figures, dates and mechanisms, or it will be litigated again.
- Leaving the home loan unaddressedA decree does not bind the bank. Who pays, who is released, and how the transfer happens must be dealt with expressly.
- One advocate acting for both partiesIt is a conflict, and it produces terms that favour whoever briefed the advocate. Independent advice on both sides makes the settlement more durable, not less.
- Withdrawing consent at the second motionEither party may, and the petition fails. If there is genuine doubt, resolve it before the first motion rather than after.
