Maintenance in Pune can be claimed under Section 125 BNSS before the Magistrate, under the Domestic Violence Act, or within matrimonial proceedings before the Family Court. Interim maintenance is commonly decided within one to three months of filing, and is independent of whether a divorce petition has been filed.

There is no fixed percentage, whatever the internet says. Courts weigh the paying spouse's actual income and obligations against the applicant's needs, earning capacity and the standard of living during the marriage. Which means the case turns on what each side can document — salary slips, returns, bank statements, lifestyle evidence — and not on what either side asserts.

Because the interim figure often runs for years before it is revisited, it deserves the preparation many parties reserve for the final hearing.

  • Accepting an informal arrangementUnrecorded payments are unenforceable and frequently stop. Have any agreed figure recorded in an order or a registered agreement.

How much maintenance will the court award?
There is no fixed formula or percentage. Courts assess the paying spouse's actual income and existing obligations, the applicant's needs and earning capacity, and the standard of living during the marriage. The award follows the documents each side puts before the court.
Can I claim maintenance without filing for divorce?
Yes. Maintenance under Section 125 BNSS is entirely independent of any divorce petition, and the Domestic Violence Act provides monetary relief on its own footing. Many claims are made while the marriage continues.
How quickly can I get interim maintenance in Pune?
Interim maintenance is typically decided within one to three months of filing, often across the first few effective hearings. Speed depends almost entirely on how complete the income documentation is when the application goes in.
Can a husband claim maintenance from his wife?
Under some matrimonial statutes, maintenance is expressed in gender-neutral terms and a husband may claim, though in practice such awards are uncommon and require showing genuine inability to maintain himself. Section 125 BNSS is framed differently.
Can maintenance be reduced if my income falls?
Yes. A material change in circumstances — job loss, illness, a fall in income, or a change in the recipient's situation — can found an application to vary the order. The change has to be genuine and evidenced, not merely asserted.
What happens if maintenance is not paid?
Arrears can be recovered through execution, attachment of salary or property, and in persistent default the court has coercive powers including imprisonment. Keep a precise record of what was due and what was actually received.
Is maintenance payable for children too?
Yes, and a child's right to maintenance is independent of the disputes between the parents. It covers everyday expenses, education and medical costs, and generally continues until the child attains majority — longer for a child unable to maintain themselves.
Does maintenance stop if the recipient remarries?
Maintenance to a former spouse generally ceases on remarriage. Maintenance for children does not — it continues regardless of either parent's remarriage.
